| All natural stones are products of nature
and are subject to variations in color, shading,
veining and inclusions. Due to the varying
characteristics of natural stone products,
the customer and the installer MUST INSPECT
the material for acceptability PRIOR TO INSTALLATION
and prepare any blending required to meet
the owner's approval. Absolutely no claims
will be accepted nor allowances made after
the material is installed. No claims will
be considered unless made within 15 days after
receipt of material. Use of product constitutes
acceptance of product. STONE & TILE, INC.
HAS NO LEGAL LIABILITY FOR ANY INCIDENTAL
OR CONSEQUENTIAL DAMAGES RESULTING FROM INFORMATION
CONCERNING INSTALLATION AND INSTALLERS. |

| All tile sold is subject to variations in
shade and size from tile to tile, from shipment
to shipment, and from samples. |

| Installation and Maintenance |
| |
| Natural stone products require reasonable
care after installation. We suggest you discuss
installation and maintenance requirements
with your salesperson prior to installation.
Stone & Tile Inc. assumes no responsibility
for improper maintenance or damages occurring
during or after installation. |

| No guarantee is made against wear. All tiles
will scratch and wear. Degree of wear is a
function of maintenance and abrasion. Stone
& Tile Inc. is not responsible for failures
resulting from improper maintenance or tiles
being installed in areas where they are not
suitable. |

| Returns |
| |
| All product must be returned at the customer's
expense and in undamaged condition. All tile
is sold and returned in full case/box quantities
only. Stone & Tile Inc. will require proof
of purchase prior to any refund or credit.
Purchases made within one year will be given
refund or credit for original invoice price
paid to the original account holder. Stone
& Tile Inc. does not accept returns of discontinued
tile, of special order products, and/or purchases
made one year or older. Liquid product returns
must be within 90 days. We will not accept
any opened or frozen liquid material. |

| Warranties and Limitation of Liability |

| Stone & Tile Inc. makes no warranty, express
or implied, by statute or otherwise, regarding
products sold, their fitness for any purpose,
their quality, their merchantability, or otherwise.
Any liability arising in any way out of this
sale shall be limited to the total amount
paid by the customer for the products purchased.
In no event shall Stone & Tile Inc. be responsible
for the costs of substitute goods or for any
special, consequential, incidental, or indirect
damages however caused, or alleged to have
been caused, on any theory or liability. |
